Yearly payment reviews for Medicaid care providers
Effective May 13, 2025, Vermont requires reasonable, adequate payment rates for community-based Medicaid care providers. Covered services operate under Vermont’s Global Commitment to Health Medicaid demonstration or its successor. They include home and community care for older adults and adults with disabilities, outside nursing homes, including enhanced residential care. They also include home health, hospice, adult day rehabilitation, and assistive community care. Mental health, substance use, developmental or intellectual disability, and brain injury supports are included outside clinical or private nonmedical residential settings. The state must use Vermont labor and operating costs and consider costs from government mandates, inflation, and labor-market changes. It may also consider regional wage, benefit, housing, and real estate costs. Rates must be recalculated at least yearly, with rate studies at least every five years. The state must set a predictable schedule for resetting base rates and a process for annual inflation adjustments. It must consider providers’ financial needs from client absences only as federal Medicaid rules allow. Designated and specialized service agencies must follow the same rate-setting framework. Providers at imminent risk of closing because of financial problems can request stabilization help, but approval and funding are not guaranteed. The state must report rates and needed funding to legislative committees each year as part of its budget presentation. An implementation report is required by January 15, 2026, covering the rate-study schedule and payment methodology. The law sets no payment amounts or direct household payments.
