Beginning April 24, 2025, Vermont spouses retain creditor protection when transferring property owned as tenants by the entirety into trusts. This married-couple ownership protection covers either spouse’s separate creditors, including in bankruptcy, and also protects sale or other disposal proceeds. Joint or separate trusts qualify, whether revocable or irrevocable. The property must remain the spouses’ property, held in trust or deeded back to them as tenants by the entirety. Both spouses must be current beneficiaries of a joint trust holding the whole property. Alternatively, each must be a current beneficiary of a separate trust, with both trusts together holding the whole property. Other beneficiaries are allowed. For joint trusts, either spouse must be able to revoke the trust alone, but changes require both spouses. Protection applies unless the transferring trust creator or creators opt out in writing, and ends when a court dissolves the marriage. It covers trusts and transfers from before, on, or after April 24, 2025, and trust court proceedings started on or after that date.
