Faster access to stalking and sexual assault orders
Beginning September 1, 2025, people who are not family or household members can file in Superior Court for a temporary order against stalking or sexual assault with a sworn statement. The Court Administrator may partner with public or private groups to help applicants, and police must assist. After regular hours, a designated person accepts requests by phone or secure electronic means, can swear you in by phone under penalty of perjury, and sends your affidavit to a judge. The judge decides based on the affidavits. If an order issues, it is sent to law enforcement for service and to the holding station.
In-court notice counts as service
Beginning September 1, 2025, if a defendant is at the hearing and the judge states on the record that an order was issued, that counts as service. The defendant must follow the order right away. The court sends the order to law enforcement for additional service, and the clerk mails a copy to the last known address.
