More reasons to end mobile home tenancies

Operators can end tenancies when a site or community permanently leaves the rental market. They can also end them when building or health authorities require rentals to stop and the property to be vacated. A home’s unsafe condition or appearance that disrupts others’ use and enjoyment of the community is another ground. Other grounds include refusing to sign or submit a lease, materially false application information, or failing nondiscriminatory application requirements. Breaking a community rule against a resident owning more than one home is also grounds; applicable state eviction-notice rules still apply.

Mobile home residents get advance closure notice

Owners or operators must give all known residents and occupants at least 90 days’ written notice before permanent retirement. This requirement applies when either a home site or the whole community leaves the rental housing market.

Mobile home leases gain protections and exceptions

Home-site rental agreements must be written leases lasting at least one year. A shorter term is allowed only when the resident or occupant requests it and the operator agrees. If a lease or renewal is not signed and returned, the operator may keep the tenancy month-to-month. Operators cannot deny or refuse to renew a lease based partly or entirely on the home’s age. They also cannot set or change lease terms for that reason.

Who gets mobile home rental protections

Wisconsin’s community rental rules cover plots with at least 3 mobile or manufactured homes used for living or sleeping. Farms are excluded when occupants work there or are the owner’s or operator’s parents, children, brothers, or sisters. A resident owns the home and rents its site from the operator, even without living there. An occupant lives with the resident in that home and has the operator’s consent. Someone renting the home without its owner living there falls under general landlord-tenant law instead.
