Bill Overview

Analyzed Economic Effects

6 provisions identified: 4 benefits, 1 costs, 1 mixed.

Property ads must disclose misleading edits

Beginning January 1, 2027, Wisconsin real estate agents must disclose misleading technology edits in all property advertising. This includes artificial intelligence used to add, remove, or change property features in a false or misleading way. The rule applies when edits create a misleading impression, not to every technology-assisted edit.

Consumers get brokerage payment and referral disclosures

Beginning January 1, 2027, Wisconsin real estate agents need all transaction parties’ prior written consent to accept transaction-related non-client compensation. The law allows out-of-state brokers to receive compensation under the specified cooperative agreement. Agents recommending service providers must disclose in writing any compensation they may receive or interest they hold in the provider. The referral disclosure rule remains subject to the exception in Wisconsin statute 452.19(1m)(a). These rules do not set payment amounts.

Homeowners control signing and property access

Beginning January 1, 2027, Wisconsin owners of residential properties with one to four units can authorize electronic signatures. This covers documents related to agency agreements and disclosures requiring signatures; electronic signing is optional. Owners can also name agents, prospective buyers, or prospective tenants they do not want to work with or admit for showings. These exclusions must comply with state and federal law.

Public home listings with owner opt-outs

Beginning January 1, 2027, Wisconsin listing firms have new duties for residential properties with one to four units. They must share information with agents representing buyers or tenants, answer their inquiries, and make properties available for showings. Within one business day after the agency agreement starts, firms must market the property online to the public and agents. Owners can opt out of public marketing by signing the department’s form, stating their request and reason. They must acknowledge that people may not know the property is available, and online listings or terms may be unavailable. They must also acknowledge that less exposure may lower offers and the sale or lease price. The Wisconsin Real Estate Examining Board must publish a brochure explaining marketing benefits, risks, opt-outs, price effects, and questions to ask.

Home listing agents gain liability protection

Beginning January 1, 2027, Wisconsin agents receive civil liability protection for good-faith statements made while carrying out required listing duties. This applies to covered residential properties with one to four units. The protection limits households’ ability to hold agents civilly liable for those statements. It does not cover statements agents knowingly make that are false, deceptive, or misleading.

Home brokerage payments face new limits

Beginning January 1, 2027, new Wisconsin payment rules apply to brokerage transactions involving residential properties with one to four units. Firms cannot accept brokerage compensation from another firm, regardless of whom the firms represent; permitted referral and finder’s fees remain allowed. Agreements breaking that ban are void and unenforceable. Seller payment to a non-listing firm must appear in the completed offer or option to purchase, signed by buyer and seller. A non-listing firm cannot accept non-client compensation unless documented there; listing contracts cannot require or imply seller payment without that condition. Listing contracts must also state whether sellers authorize disclosure of that compensation offer to other firms. These rules make payment arrangements explicit but do not set payment amounts.
