Beginning 90 days after April 12, 2025, West Virginia replaces work permits for 14- and 15-year-olds with age certificates. Before employment, employers must obtain and keep a state-issued age certificate and written consent from a parent, guardian, or custodian. These records must be available to enforcement officers. Certificates require proof of age and review of school attendance, the planned job, the employer’s job description, consent, and work hours. Existing limits on work hours and banned jobs still apply. The labor commissioner keeps certificate records and can revoke improperly issued certificates after an investigation and hearing. Employing a child under 16 without a required certificate violates the law. Violations, improper certificate issuance, and false information are misdemeanors, with first-offense fines of $50 to $200. Repeat offenses carry fines of $200 to $1,000, up to six months in jail, or both.
