Effective upon passage, the law ends West Virginia’s special volunteer occupational therapist license. It also removes the related protection from civil liability for therapists who provide free services to people with little money.
Effective upon passage, West Virginia’s occupational therapy board can require state and national background checks for interstate practice permission. This applies to occupational therapists and assistants seeking a compact privilege, which allows practice across member states. Applicants must submit fingerprints, authorize State Police and FBI screening, and pay the actual fingerprinting and check costs. Results are not public; release is limited to the person checked, written consent, or a court order. The board can propose rules for legislative review during the 2026 session, subject to required deadlines.
