Wyoming oil operators get five-year tax break

Beginning July 1, 2026, the law exempts qualifying tertiary oil production from the severance tax under W.S. 39-14-204(a)(iii). The Wyoming Oil and Gas Conservation Commission must certify projects after July 1, 2026, and before July 1, 2031. First tertiary production must occur after certification. The tax break lasts five years from that first production date, rather than covering all oil production or all taxes. The Commission and the Department must report annually by November 1, starting in 2026 and continuing through 2036. Reports must show qualifying production amounts, operator counts, well counts, and severance taxes paid and exempted. They must also show property and sales taxes paid in connection with that production.
