New benefit accounts for independent contractors

Beginning July 1, 2026, Wyoming independent contractors can open portable benefit accounts with eligible providers and name a beneficiary. Accounts fund health, vision, dental, life insurance, income replacement insurance, or retirement benefits. Anyone, including hiring companies and app-based platforms, can contribute voluntarily; no contribution amount is guaranteed. Hiring parties can contribute their own money or withhold an agreed percentage of a contractor’s pay. Both arrangements require the contractor’s clear written agreement, prominently displayed in the work contract or a separate agreement. Pay withholding starts only after the contractor opts in, and the contractor can opt out at any time. Hiring parties can opt out with at least 60 days’ notice. Contributions cannot be used to decide worker classification under Wyoming law. Eligible providers include financial institutions, investment firms, and technology providers or program managers working through those institutions or firms. Other providers must demonstrate compliance to the state banking commissioner. The Department of Workforce Services must issue implementation rules; that requirement took effect upon enactment.
