New location and eligibility rules for simulcasting
Beginning July 1, 2026, you must have a state simulcasting permit and local approval to operate. Only applicants already authorized to run another pari‑mutuel event can get a simulcasting permit. You cannot run simulcasting within 100 miles of a live pari‑mutuel event while it is happening, unless the live permitholder gives written approval and the commission waives the limit. Sites inside a city need city approval; sites outside need county approval. Cities or counties can file written objections within 30 days, and no approval is issued until timely objections are resolved. Moving a site inside the same local area can be treated as a renewal; moving outside that area is a new application.
Simulcasting permit steps, fees, and appeals
Starting July 1, 2026, file your application with the local authority; renewals are due at least 90 days before expiration. Pay the real cost to publish the required notice when you file. Local permit fees cannot exceed the government’s actual costs. The local authority must publish notice once a week for two weeks and post it online, then hold a meeting to hear protests (for renewals, at least 30 days before expiration). Locals can set reasonable conditions, like hours no stricter than alcohol sales hours and where historic horse racing terminals go, but they cannot set terms the state controls; approval terms must match the commission’s term. Local approval can be revoked or renewal denied only for good cause (for example, a breach not fixed within 10 business days after notice, a commission violation, failure to start within two years with a possible one‑year extension, or serious harm to nearby residents), and denials must include written findings. If your renewal is denied or local approval is revoked, you can appeal in district court; new applicants may appeal only if that local government has granted a simulcasting permit before.
Transition timeline for current operators
If you held a simulcasting permit on July 1, 2026, you may keep operating under your current terms through December 31, 2027. Starting July 1, 2027, the new statewide rules apply to you. After that date, local governments may deny or withhold approval only for the good causes listed in the law.
State oversight and permit structure
Beginning July 1, 2026, the state gaming commission writes rules for simulcasting and assigns stewards to oversee each simulcast location and live event. At least one steward is a commission employee. Simulcasting permits align with the pari‑mutuel event framework but are governed by their own section; general permit issuance and bond rules do not control unless the simulcasting law allows.
