Title 10 › Subtitle Subtitle E— Reserve Components › Part III— PROMOTION AND RETENTION OF OFFICERS ON THE RESERVE ACTIVE-STATUS LIST › Chapter 1407— FAILURE OF SELECTION FOR PROMOTION AND INVOLUNTARY SEPARATION › § 14512
Certain Army and Air Force reserve officers in top jobs must leave service on the last day of the month they turn 66, unless they already retired, moved to the Retired Reserve, or were discharged earlier. This covers leaders like the Chiefs of the Army and Air Force Reserve, the Directors of the Army and Air National Guard, adjutant generals, and, for Army reserve officers, the State commanding generals. The Secretary of the Navy can delay retirement for Navy reserve officers above captain and Marine reserve officers above colonel and keep them active until they turn 66. No more than 10 officers may be delayed at one time, split between Navy and Marine reserves as the Secretary decides. The Secretary of Defense can also delay retirement for the Chief of the Navy Reserve or the Commander of Marine Forces Reserve, but only until the first day of the month after the officer turns 66; those delays do not count against the 10-officer limit.
