If money is available, the Secretary concerned may pay approved conservation banks or in-lieu-fee mitigation sponsors under federal guidance dated November 28, 1995; May 2, 2003; November 7, 2000; or related guidance. These payments can only be used to help military testing, operations, training, other military activities, or military construction. Payments that support military construction can be counted as eligible construction costs. The money for these payments can come from operation and maintenance; military construction; research, development, test, and evaluation; or the Support for United States Relocation to Guam Account created by section 2824 of the Military Construction Authorization Act for Fiscal Year 2009 (Public Law 110–417). "Secretary concerned" means a military department secretary or the Secretary of Defense for a Defense Agency.
