Title 15 › Chapter 48— HOBBY PROTECTION › § 2102
If someone breaks the Act’s rules, a person who is affected can sue in federal court to stop the wrongdoing and to get money for harm. The suit can be filed in a U.S. District Court where the defendant lives, has an agent, does business, or wherever federal venue rules allow (28 U.S.C. 1391). The court may make the loser pay court costs and reasonable lawyer fees. If the violation also uses, without permission, a registered trademark of a collectibles certification service, the trademark owner can also use the remedies in the Trademark Act (sections 34, 35, and 36 — 15 U.S.C. 1116, 1117, 1118).
