Title 15 › CHAPTER 52 — ELECTRIC AND HYBRID VEHICLE RESEARCH, DEVELOPMENT, AND DEMONSTRATION › § 2509
Guarantees loans to help bring electric and hybrid vehicles into the U.S. fleet and to make sure small businesses and other eligible borrowers can get money when they lack capital. The Secretary of Energy can promise to guarantee loan principal and interest for things like research, prototypes, building equipment, and initial operating costs for vehicles and parts. A guarantee can cover up to 90% of the loan amount. Loans must be repaid in 15 years or less and have an interest rate the Secretary finds reasonable. The Secretary must also find the loan amount is enough, that repayment is reasonably likely, and that the borrower cannot get other reasonable financing. Each guarantee is normally limited to $3,000,000 unless the Secretary finds a larger amount is needed and immediately tells the Speaker of the House, the President of the Senate, the House Science, Space, and Technology Committee, and the Senate Commerce, Science, and Transportation Committee. All guarantees outstanding at one time may not exceed $60,000,000. The law creates an Electric and Hybrid Vehicle Development Fund in the U.S. Treasury to pay guarantees, interest assistance, and admin costs. The fund gets money from appropriations and returned payments, can be invested, must report its operations to Congress each year, and unused funds may go to the Treasury general fund after the 7-year period following September 17, 1976. A "qualified borrower" is a company or legal entity that shows interest in the technology and can do the work. Applicants must be U.S. citizens or nationals, with special rules for corporations and a possible waiver for firms controlled by citizens of countries in the International Energy Agreement. If a borrower cannot pay, the Secretary may pay the lender in certain cases, and the Attorney General can recover losses from the borrower or sureties. The full faith and credit of the United States backs these obligations.
