It is illegal for anyone who knowingly creates, makes, gets, moves, keeps, has, uses, or threatens to use a chemical weapon. It is also illegal to help, persuade, plan, or try to get someone else to do any of those things. There are narrow exceptions. U.S. departments, agencies, or people properly allowed by law or a U.S. officer (including members of the Armed Forces) may hold or handle such weapons while they wait to be destroyed. In an emergency, a person who would not normally be guilty may act to destroy or seize a weapon. The United States has authority over these crimes when they happen in the U.S.; when done abroad by a U.S. national; when done abroad against a U.S. national; or when done against property owned, leased, or used by the United States or any U.S. department or agency, inside or outside the U.S.
