Importing softwood lumber or softwood lumber products while knowingly breaking this subtitle is illegal. Each knowing violation can bring a civil fine up to $10,000. The importer can also face other civil or criminal penalties under U.S. customs law and Title 18, and the goods described in section 1683b(a) may be seized. Officials set fines by looking at prior violations, ability to pay, how serious the offense was, and fairness. No fine may be imposed without notice and a chance to speak in writing and orally. An importer won’t be treated as violating section 1683a(c) if they made the inquiry required by 1683a(c)(1), produced records under 1683e(b), and there is no strong evidence they knew their declaration was false.
