The Trade Representative must watch whether a foreign country actually carries out any fix or agreement that was made after a U.S. trade investigation or after a dispute settlement ruling. If the Trade Representative finds the country is not carrying out the measure or agreement, the Trade Representative must decide what further steps to take under section 2411(a). Any such decision is treated as a determination under section 2414(a)(1). If the matter involves a World Trade Organization recommendation, the Trade Representative must make that decision no later than 30 days after the end of the “reasonable period of time” set under paragraph 21 of the WTO’s Understanding on Rules and Procedures Governing the Settlement of Disputes. If the United States imposes retaliatory duties or other actions under section 2411(c)(1)(A) or (B) because a country failed to implement a WTO recommendation, the Trade Representative must regularly revise the list of targeted goods to affect other products of the noncomplying country, unless implementation is clearly imminent or the Trade Representative and the petitioner agree a revision is unnecessary. The Trade Representative must review the retaliation list 120 days after it is first used and every 180 days after that, act to encourage compliance or a mutually acceptable solution, consult the petitioner, and allow interested persons to present views. The “retaliation list” is the set of foreign products singled out for duties above the normal Harmonized Tariff Schedule rates. If action ended under section 2417(c) and a petitioner asks in writing for reinstatement and the Trade Representative has completed the steps in subsection (d) and section 2417(c)(3), reinstatement may be considered.
