Title 25 › CHAPTER 32 — NATIVE AMERICAN GRAVES PROTECTION AND REPATRIATION › § 3006
Within 120 days after November 16, 1990, the Secretary must set up a seven-member review committee to watch how museums and agencies carry out the inventory, identification, and repatriation work required under the law. Three members must come from lists nominated by Indian tribes, Native Hawaiian organizations, and traditional Native American religious leaders, with at least two being traditional Indian religious leaders. Three must come from national museum and scientific organizations. One member is chosen from a list all the other appointees agree on. The Secretary cannot appoint federal officers or employees. If a vacancy happens, the Secretary must fill it within 90 days. Members do not get a salary, but are paid the GS‑18 daily rate for days they work and receive travel pay and per diem under sections 5702 and 5703 of title 5. The committee picks its chair and must monitor inventories and identifications, review identity or return questions when asked, help resolve disputes, and make an inventory and recommendations about culturally unidentifiable human remains. It must consult tribes, Native Hawaiian organizations, museums, and the Secretary on rules and other work, and it may suggest future care for returned items. Records and findings the committee makes can be used in actions under section 3013. The Secretary must give the committee access to items and documents, set rules for the committee, and provide staff help. The committee must send an annual report to Congress and ends 120 days after the Secretary certifies in a report to Congress that the work is done.
