Title 29 › CHAPTER 32 — WORKFORCE INNOVATION AND OPPORTUNITY › SUBCHAPTER I — WORKFORCE DEVELOPMENT ACTIVITIES › Part A — System Alignment › subpart 1 — state provisions › § 3111
The Governor must set up a State workforce development board. The board must include the Governor, one member from each house of the State legislature when allowed by State law, and people the Governor appoints. Most appointees must be business leaders who hire workers and represent growing industries. At least 20% must be workforce representatives (like labor unions, apprenticeship program reps, and groups that help people with barriers to work or out-of-school youth). The rest must include State and local government officials, including leaders of the main workforce programs and chief elected officials. Members must come from different parts of the State (urban, rural, suburban). No one person can count in more than one membership category. The Governor must pick the board chair from the business representatives. A State can use an older similar State entity instead of a new board if it existed on August 6, 1998 and has both business and labor representatives. The board must help the Governor make and improve the State workforce plan and review statewide workforce policies and programs. It must work to fix barriers, support career pathways, reach out to jobseekers and employers, meet employer needs in key industries, pick planning regions and local areas, and improve one-stop career centers and staff training. The board also must help set performance measures, share best practices, make rules for one-stop centers (including funding and cost sharing), improve technology and data systems to help services and reporting, make funding formulas for local areas, prepare required annual reports, and build the State labor market information system. Board members cannot vote or act on matters that directly benefit themselves, their family, or the organizations they represent. The board must share its plans, membership, and meeting minutes with the public online and in open meetings. The board may hire a director and staff, must set objective job qualifications for the director, and must follow salary limits set by law.
