The Secretary of the Army may take back rifles, ammunition, repair parts, or other supplies that were given as grants to another country under section 505 of the Foreign Assistance Act of 1961 (22 U.S.C. 2314) if those items became excess to that country and were legally obtained by the person offering them. The Army can accept these items even if 31 U.S.C. 1342 might otherwise limit acceptance, but it may not take anything if the United States would have to pay for the acquisition. The Army must only transfer the items inside the United States to the same person who provided them, and only if that person is licensed under 18 U.S.C. 923(a) as a manufacturer, importer, or dealer, and uses an Army ammunition depot that is eligible to receive them. The Army must get fair market value for each item. The Army may use sole-source contracts under paragraphs (4) and (5) of 10 U.S.C. 3204(a) to carry out these actions, and all transfers must follow the Arms Export Control Act (22 U.S.C. 2778). The term "rifle" has the meaning given in 18 U.S.C. 921.
