Federal construction contracts over $100,000 that fall under Reorganization Plan No. 14 of 1950 must require that workers not be made to work in unsanitary, hazardous, or dangerous conditions. The Secretary of Labor must write safety and health rules for these jobs using a rulemaking process that includes a hearing like the one in section 553 of title 5, and must consult an Advisory Committee when making those rules. The Secretary can inspect jobs, hold hearings, issue orders, and take other steps needed to get contractors to follow the rules. If a contractor fails to follow the rules, the agency can cancel the contract and charge the contractor any extra costs, or a supporting agency can withhold guarantees, aid, or insurance tied to the work. Section 3703 does not apply to enforcing these rules. If a contractor or subcontractor repeatedly breaks the rules willfully or through gross negligence and the Secretary finds that regular enforcement is not protecting workers, the Secretary will give notice and, not sooner than 30 days later, send the contractor’s name to the Comptroller General. The Comptroller General will tell all federal agencies, and the named firm cannot get covered contracts for three years unless the Secretary lifts the ban sooner after a hearing. A person affected by the Secretary’s action may ask the United States court of appeals to review it within 60 days; the Secretary must file the record, the Secretary’s factual findings supported by enough evidence are final, and the court may enforce, change, or set aside the Secretary’s order. The Department of Labor has an Advisory Committee of nine members (three contractor representatives, three construction worker representatives, and three public experts). The Secretary picks the chair, may hire extra experts, and committee members may be paid up to $100 a day plus travel and expenses.
