Title 42 › CHAPTER 149 — NATIONAL ENERGY POLICY AND PROGRAMS › SUBCHAPTER XVII — PROTECTING AMERICA’S COMPETITIVE EDGE THROUGH ENERGY › § 16539
Starting 180 days after December 20, 2019, the Secretary of Energy (working with the Secretary of Labor) can create the Department of Energy National Lab Jobs ACCESS Program. The program can award competitive five-year grants to pay part of the cost of pre-apprenticeship and apprenticeship programs. These programs must lead to recognized postsecondary credentials. They must teach technician skills needed by National Laboratories and certain NNSA facilities (for example, machinists or cybersecurity technicians). Each program must be created with a lab or facility, be registered with the Secretary of Labor or a State apprenticeship agency, and must not replace paid employees. Eligible applicants are workforce intermediaries or approved program sponsors with experience building career paths, ties to a lab or facility, knowledge of its workforce and security needs, and the ability to recruit, train, credential, and place graduates. Applicants follow the Secretary’s rules to apply. The Secretary can give priority to industry partnerships, programs using local schools or community colleges, pre-registered apprenticeships, military or veteran transition programs, state-funded partners, and programs for young adults ages 16–29 or people with employment barriers. The Secretary may also consider regional balance and offer technical help. Each eligible entity may submit only one application per fiscal year. Grants may not exceed $500,000 for any 24-month span and must have at least a 25 percent non‑Federal share. If the program exists, the Secretary must report to Congress and post online at least every two years on grantees, activities, best practices, and employment outcomes; program operators must report after one year and then yearly.
