The Secretary can take steps to reduce drought losses using the powers already allowed by current contracts and by state and federal law. The Secretary may build, manage, and conserve water supplies. Most new facilities must be temporary, but wells dug to reduce drought harm may be permanent. The Secretary can help willing buyers get water from willing sellers without giving money. The Secretary can also buy water from willing sellers, including water saved by Federal Reclamation project contractors. That water is normally delivered under temporary contracts under section 2212, except water held or moved for Federal or State wildlife habitat. Any contract must recover the Secretary’s costs, including interest. The Secretary may join state water banks.
