Title 5 › Part III— EMPLOYEES › Subpart B— Employment and Retention › Chapter 33— EXAMINATION, SELECTION, AND PLACEMENT › Subchapter I— EXAMINATION, CERTIFICATION, AND APPOINTMENT › § 3329
The Secretary of Defense must make sure that a military reserve technician who is involuntarily separated from technician service can get help finding a new Defense Department job through a priority placement program, if the person had at least 15 years as a technician and 20 years of service creditable under 10 U.S.C. 12732, and files a written application within 1 year after separation. "Military reserve technician" means the same as "military technician (dual status)" in section 8401(30). The job offered must be inside the Department of Defense, in either the competitive or excepted service, and the person must be qualified for it; the program should, as much as possible, place the person at a pay rate not lower than their last basic pay. This does not apply if the separation was for misconduct or delinquency, or if the person is already eligible for immediate (including disability) or early retirement under subchapter III of chapter 83 or chapter 84. The Secretary must make rules with the Office of Personnel Management to run the program.
