When the Secretary makes a decision about an air traffic controller, the controller must get a written notice saying what the decision is and why. The notice must tell the controller they have 15 days after receiving it to ask in writing for reconsideration. If the controller does not ask within 15 days, or if the Secretary cancels the decision within 15 days, the decision becomes final. If the controller asks for reconsideration and the Secretary does not cancel the decision within 15 days after getting the request, the Secretary must immediately set up a three-person review board: one person the controller picks, one agency representative the Secretary picks, and one member from the Merit Systems Protection Board who will lead the board. The board reviews all evidence and must give written findings within 30 days. The board can keep or cancel the Secretary’s decision, and its decision is final. The Secretary must carry out the board’s decision. Except where a different rule applies, this review is the only internal administrative remedy for a controller in their agency.
