When a hearing is required under section 556, the person who ran the hearing usually must write the first decision. That first decision becomes the agency’s decision unless someone asks the agency to review it in the time set by rule. If the agency reviews the decision, it has the same power as the first decisionmaker, unless the agency limits the issues. If the agency did not run the hearing, the hearing officer or a qualified employee must first recommend a decision, except in rulemaking or first-time license cases where the agency can issue a tentative decision, have a responsible employee recommend one, or skip the recommendation if urgent action is needed. Before a recommended, initial, tentative, or reviewed decision, parties must have a fair chance to send proposed findings and conclusions, exceptions, and the reasons that support them. Final decisions must say the findings and reasons on all important facts, law, or choices and state the rule, order, sanction, relief, or denial. In these agency hearings, outside people with a stake in the case and agency members or staff who will decide the case must not make private communications about the merits to each other, except where the law allows limited contacts. If a prohibited communication happens, the written messages, notes describing oral talks, and any responses must be put on the public record. If a party knowingly makes a forbidden contact, the agency or judge may require that party to explain why their claim should not be dismissed, denied, or otherwise hurt. The no-contact rule starts when the agency says so but no later than when the hearing is officially noticed, unless the communicator already knew the hearing would be noticed. This does not allow withholding information from Congress.
