When an annuity under this subchapter starts or is restored, the person gets 60 percent of their average pay for the first 12 months that begin on or after that date. After those 12 months, the annuity drops to 40 percent of average pay. During the first 12 months, the annuity is not changed by pay-adjustment rules in section 8462. After the first 12 months, the annuity is changed to reflect any section 8462(b) adjustments that happen after that period. If the person also gets Social Security disability (under section 223), the annuity is reduced for any month they get both benefits: during the first 12 months it is reduced by 100 percent of their "assumed" Social Security disability benefit for that month, and after that it is reduced by 60 percent of the assumed benefit. The "assumed" Social Security benefit is the disability amount they were entitled to in the month the annuity began or was restored (or the first month they had both benefits) and is adjusted by any 8462(b) changes that apply before the month being paid. For applying Social Security rule 224 to this reduction, use the annuity amount before the reduction. Section 8462 only applies here as described above. If a person had an annuity the day before they turn 62, the Office must recompute the annuity on that birthday and replace the old amount. The new amount is what they would get under section 8415, but it must count any earlier time they were on this annuity as service and must adjust the average pay for any section 8462(b) changes during those earlier periods. Also, if an annuity starts or is restored on or after the redetermination date, or if the person already meets the age-and-service rules for regular retirement when the annuity starts, the annuity is computed under section 8415. Finally, after any Social Security reduction, the annuity paid cannot be less than the amount computed under section 8415 (excluding subsection (h)), and that 8415 amount is adjusted under section 8462 as if it started when the annuity began or was restored.
