The Office of Personnel Management must hire one or more qualified insurers, without using the usual competitive‑bidding rules, to offer long‑term care insurance. Each contract must be chosen based on the insurer’s qualifications, price, and reasonable competition. Every contract must spell out the benefits (including limits and exclusions), the premiums and any rules for changing them, the enrollment rules, and any other agreed terms. Premiums must fairly match the cost of the benefits and cannot be raised during the contract unless both OPM and the insurer agree. Contracts cannot be automatically renewed and normally last 7 years. The 7‑year period starts on the earliest date any coverage under the program takes effect. The President must send a recommendation to certain Congressional committees no later than 180 days after receiving the program’s second report, and OPM cannot rebid coverage during the 180 days after that recommendation. Insurers must pay benefits when a person qualifies and must have fast internal claim procedures plus independent third‑party review for disputes that remain unresolved. Decisions about whether someone can get coverage can be reviewed only as the contract allows. Contract appeals go to a board of contract appeals named by the OPM Director, and certain court actions may be brought in U.S. district courts as well as the U.S. Court of Federal Claims. Neither OPM nor reviewers can change contract terms. Once someone is properly enrolled, their coverage cannot be ended because they leave government service, stop being a qualified relative, or, during a lapse in appropriations, are furloughed or working without pay; coverage cannot be canceled for missed premiums caused by that lapse.
