Federal LLMs Must Meet ‘Unbiased’ Rules
If you supply large language models (LLMs) to the federal government, agencies are required to procure only LLMs that follow two Unbiased AI Principles: Truth-seeking and Ideological Neutrality. This policy applies to executive departments, military departments, independent establishments, and wholly owned Government corporations, and will be implemented alongside OMB guidance required under the order.
Contracts Can Require Vendors to Pay Decommissioning
Federal contracts for LLMs entered into after the OMB guidance must include terms requiring the LLM to comply with the Unbiased AI Principles and may charge decommissioning costs to the vendor if the agency terminates the contract for the vendor's noncompliance after a reasonable cure period. Agencies are also instructed, where practicable, to revise existing LLM contracts to include these terms.
Transparency Expectations for Vendor Disclosures
OMB guidance will permit vendors to comply with the Ideological Neutrality principle by disclosing an LLM's system prompt, specifications, evaluations, or other documentation to show ideological judgments, while avoiding requiring disclosure of specific model weights or other sensitive technical data where practicable. The guidance will also account for technical limits and avoid over-prescription.
Timetable: OMB Guidance and Agency Procedures
The Director of OMB must issue implementation guidance within 120 days of the July 23, 2025 order, and each agency must adopt procedures to ensure LLMs they procure comply with the Unbiased AI Principles within 90 days after that OMB guidance is issued. Contracts entered after the OMB guidance must include the new compliance terms.
National Security Systems Can Be Excepted
The OMB guidance must make exceptions as appropriate for the use of LLMs in national security systems, allowing those systems to be treated differently from other federal procurements. Agencies may apply the Unbiased AI Principles differently for national security uses.
