77.63% Antidumping Duty Rate Set

If you import hard empty capsules from Brazil, Commerce calculated an estimated dumping margin of 77.63% for ACG do Brasil S.A. and assigned the same 77.63% rate to all other Brazilian producers/exporters. If the U.S. International Trade Commission (ITC) issues a final affirmative injury determination, Commerce will issue an antidumping duty order and require cash deposits of estimated antidumping duties at the 77.63% rate.

Suspension of Liquidation Dates Affect Imports

U.S. Customs and Border Protection was instructed to suspend liquidation of entries of the subject merchandise entered or withdrawn for consumption on or after May 29, 2025. Commerce directed CBP to discontinue suspension for entries on or after November 25, 2025, but continue suspension for entries on or before November 24, 2025.

Which Capsules Are Covered

The rule covers hard empty capsules from Brazil defined as two prefabricated hollow sections (cap and body) that are at least 80% by weight of a water-soluble polymer and that disintegrate in aqueous tests within 2 hours under USP-NF Chapter 701 (or equivalent). The notice also lists relevant HTSUS subheadings, but says the written product description is dispositive.

Refunds If ITC Finds No Injury

If the ITC determines there is no material injury or threat of material injury, the proceeding will be terminated, the suspension of liquidation will be lifted, and all cash deposits for estimated antidumping duties will be refunded or canceled.
