ITC Injury Finding Will Trigger Duties or Refunds

Commerce will notify the U.S. International Trade Commission, which will decide within 45 days whether U.S. industry is materially injured or threatened. If the ITC finds injury, Commerce will issue a countervailing duty order and require assessment of duties on imports; if the ITC finds no injury, the proceeding is terminated and any cash deposits are refunded.

10.67% Duty on Brazilian Capsules

The Department of Commerce found countervailable subsidies for hard empty capsules from Brazil and set an estimated countervailable subsidy rate of 10.67 percent ad valorem for ACG do Brasil S.A. and for all other Brazilian producers/exporters. This final determination covers the period January 1, 2023 through December 31, 2023 and is applicable December 29, 2025.

Cash Deposits and Suspension of Liquidation Dates

Commerce instructed U.S. Customs and Border Protection to collect cash deposits and suspend liquidation for entries of subject merchandise entered or withdrawn for consumption on or after March 31, 2025 (the Preliminary Determination publication date). Commerce directed CBP to discontinue suspension of liquidation for entries on or after July 29, 2025, but to continue suspension for entries on or before July 28, 2025.
