Imports from India Face New Duties

Commerce found that hard empty capsules from India were sold in the U.S. at less than fair value for the period October 1, 2023 through September 30, 2024. As a result, new antidumping duties will be effective December 29, 2025; if you import these capsules from India, expect changes to duties and procedures tied to that date.

Specified Cash Deposit Rates Set

Commerce calculated estimated weighted-average dumping margins and adjusted cash deposit rates for named Indian exporters: ACG Associated Capsules Private Limited (26.69% dumping margin; adjusted cash deposit 19.71%), HealthCaps India Limited (10.66% dumping margin; adjusted cash deposit 3.68%), and an All-Others rate (18.68% dumping margin; adjusted cash deposit 11.70%). If the ITC issues a final affirmative injury determination, CBP will require cash deposits at the applicable rates for entries covered by the order.

Suspension, Entry Dates, and ITC Decision Window

Commerce instructed CBP to suspend liquidation of entries of the subject merchandise entered or withdrawn for consumption on or after May 29, 2025, and to discontinue suspension for entries on or after November 25, 2025 (while continuing suspension for entries on or before November 24, 2025). The U.S. International Trade Commission (ITC) will decide within 45 days after this final determination whether U.S. industry is materially injured; if the ITC finds no injury, suspended liquidations will be lifted and any deposits refunded, but if ITC finds injury, duties and cash deposits will be required.
