Title 20 › Chapter CHAPTER 72— - MUSEUM AND LIBRARY SERVICES › Subchapter SUBCHAPTER II— - LIBRARY SERVICES AND TECHNOLOGY › Part Part 1— - Basic Program Requirements › § 9134

Last updated Apr 6, 2026|Official source

Summary

State library agencies must send a plan to the Director to get grant money. The plan must be sent once every 5 years as the Director decides, and it must cover 5 fiscal years. If the agency makes a major change to the plan, it must send an amendment by April 1 of the year before the change takes effect. The plan must set goals and priorities and describe the activities, steps, and ways the agency will measure success. It must explain how libraries and library users will be involved in decisions. The plan must say how the agency will work with other state offices and link efforts to other federal programs (for example, K–12 education, early childhood programs, workforce development, and other programs tied to economic, health, and digital skills). The plan must promise to follow the Internet-safety rules below and must promise to give the Director any reports the Director reasonably asks for. Each agency must evaluate and report on the grant-supported activities before the 5-year plan ends. Libraries that get help must give the state agency any information needed for that report. The Director will approve plans that meet the rules, and each approved plan must be made public, including online. If a plan does not meet the rules, the Director will tell the agency why, offer a chance to fix it, help with technical assistance, and offer a hearing. Federal funds for buying Internet-ready computers or paying direct Internet costs for certain libraries cannot be used unless the library has an Internet-safety policy with a technology protection measure (a filter). For minors, the filter must block obscene material, child pornography, and material harmful to minors. For all users, the filter must block obscene material and child pornography. The filter must be enforced when minors use computers. Libraries may also limit or protect access to other materials. An administrator can disable the filter for real research or other lawful uses. Libraries must certify compliance as part of their next funding application and each year after. If a library lacks a policy, it must certify it is working to create one in the first year and certify compliance in the second year; a waiver is allowed if procurement rules stop timely compliance, but the library must tell the Director and promise to comply before the third program year. If the Director finds a library is not following these rules, the Director may stop payments, issue a complaint, or make a compliance agreement; those are the only remedies, and payments must resume once the problem is fixed. Definitions used by the law: child pornography (see 18 U.S.C. 2256), harmful to minors (a three-part test about sexual content and value), minor (under age 17), obscene (see 18 U.S.C. 1460), and sexual act/contact (see 18 U.S.C. 2246).
