That suspension remains in place until the President issues a finding that the invasion has ceased, under the authority of 8 U.S.C. 1182(f) and 8 U.S.C. 1185(a).
Asylum and INA Protections Limited for Invading Aliens
The proclamation restricts aliens engaged in the invasion from invoking provisions of the Immigration and Nationality Act that would permit continued presence in the United States, including section 208 (8 U.S.C. 1158) for asylum, on or after January 20, 2025. Those restrictions last until the President issues a finding that the invasion has ceased.
Entry Bar for Those Lacking Pre-Entry Health or Criminal Info
The proclamation states that, on or after January 20, 2025, entry is detrimental for any alien who fails to provide sufficient medical information or reliable criminal-history/background information before entering the United States. These operational actions continue until the President issues a finding that the invasion has ceased.
