Countervailing Duties Start January 7, 2026
Commerce issued a countervailing duty (CVD) order on hexamethylenetetramine (hexamine) from India effective January 7, 2026. On that date U.S. Customs and Border Protection (CBP) must require cash deposits equal to the listed subsidy rates at the time importers normally deposit estimated duties, and Commerce will assess countervailing duties on relevant entries as described in this order.
Listed Subsidy Rates — Big Rate Differences
Commerce published estimated countervailing subsidy rates for specific Indian producers: Kanoria Chemicals and Industries Limited and All Others at 2.34 percent ad valorem, and Horizon Chemicals, Micro Labs Ltd, Shreenathji Rasayan Private Limited, and Rajsha Chemicals Pvt. Ltd at 139.57 percent ad valorem (the 139.57% rates are based on facts available with adverse inferences).
Critical Circumstances Trigger Earlier Suspensions
For any companies for which Commerce made an affirmative determination of critical circumstances, CBP will be directed to suspend liquidation of entries of subject merchandise entered, or withdrawn from warehouse for consumption, on or after December 7, 2024 (90 days prior to publication of the Preliminary Determination). The notice does not list which companies this applies to in the text.
Retroactive Assessment Window from March 7, 2025
Commerce intends to direct CBP to assess countervailing duties on entries of hexamine from India that were entered, or withdrawn from warehouse, for consumption on or after March 7, 2025 (the date of the Preliminary Determination), subject to the limited exception for entries occurring after the provisional measures expired and before publication of the ITC final injury determination.
No Duties Collected for Certain Earlier Entries
Commerce instructed CBP to terminate suspension of liquidation and to liquidate, without regard to countervailing duties, unliquidated entries of hexamine from India entered, or withdrawn from warehouse for consumption, on or after July 5, 2024 through the day preceding publication of the ITC's final injury determination in the Federal Register (i.e., July 5, 2024 through January 6, 2026).
