Countervailing Duty Rates Announced
Commerce found countervailable subsidies for oleoresin paprika from India and assigned ad valorem subsidy rates of 18.67% for Mane Kancor, 25.42% for Synthite, and 21.90% for All Others for the period April 1, 2024 through March 31, 2025. These percentages are the estimated countervailable subsidy rates Commerce will use in this investigation.
Suspension of Liquidation Continues (Retroactive Dates)
Suspension of liquidation will continue for entries of the subject oleoresin paprika that were entered, or withdrawn from warehouse, for consumption on or after February 6, 2026 through June 5, 2026. Because Commerce found critical circumstances for Synthite, suspension of liquidation will also continue for Synthite entries entered, or withdrawn from warehouse, for consumption on or after November 8, 2025 through June 5, 2026.
Possible CVD Order and Cash Deposit Requirement
If the U.S. International Trade Commission (ITC) finds, within 45 days after this final determination, that U.S. industry is materially injured or threatened with injury, Commerce will issue a countervailing duty (CVD) order, reinstate suspension of liquidation, and require a cash deposit of estimated countervailing duties for entries of oleoresin paprika. If the ITC determines there is no material injury, the proceeding will be terminated and any deposited duties will be refunded or cancelled.
