Temporary duty-free fertilizer imports
Starting July 8, 2026, exporters or importers can request that phosphate fertilizers from the Kingdom of Morocco be entered into the United States free of countervailing duties under a temporary program. This is intended to make fertilizer more affordable and available to U.S. farmers during the planting and growing season.
60-day entry deadline or duties
Any fertilizer entered under this temporary waiver must enter the United States normally within 60 days after Commerce notifies the person who submitted the request, or the merchandise will be subject to antidumping and/or countervailing duties. Meeting the 60-day window is required to keep the duty-free treatment for that shipment.
Relief is time-limited (8 months)
The President directed the Secretary of Commerce to provide emergency relief that may be used or extended during an 8-month period or for the duration of the emergency, meaning the duty-free importation is temporary. Parties should expect the relief to be limited in time and tied to the emergency period.
Scope covers all phosphate fertilizer forms
The Order covers phosphate fertilizers from Morocco in all physical forms (solid or liquid), with or without coatings or additives such as anti-caking agents, so those specific products are eligible for the temporary duty-free request process. Importers of these covered fertilizers are the parties who may seek the duty-free entries.
