Became Law

Summary

This law clarifies and limits the Confederated Tribes of Siletz Indians' hunting, fishing, trapping, and gathering rights and sets how the 1980 Siletz Agreement and any successor pacts work. It preserves the 1980 Consent Decree and Siletz Agreement as the baseline until the Tribe and Oregon mutually replace or amend them, while placing clear limits on off‑reservation harvests.

Oregon court reviews Siletz decree on merits

The federal court in Oregon must hear cases to change the 1980 Siletz Consent Decree, entered May 2, 1980. The court reviews these cases on the merits. It cannot use res judicata or collateral estoppel to block review. This applies to cases filed in that court. It takes effect now.

Rules for Siletz hunting and fishing

The law keeps the 1980 Siletz Agreement in force until a new deal replaces it. Any change must be agreed to by the Tribe and the State of Oregon. New deals cannot give the Siletz exclusive or primary take rights outside the 1855 Siletz Coast Reservation boundary. They also cannot add new or bigger fishing rights in the Columbia River or in the Willamette River up to Willamette Falls. The law does not change any treaty rights of any tribe. This applies immediately.
