Summary

Would nullify HUD's Affirmatively Furthering Fair Housing (AFFH) rules and notices. The bill would declare that HUD's proposed AFFH rule published Feb 9, 2023, the interim final rule published June 10, 2021, the final rule published July 16, 2015, and the AFFH Assessment Tool notice published Dec 31, 2015, and any successor rule or notice substantially similar to those items shall have no force or effect.

Roll back HUD fair-housing rules and data

If enacted, the bill would void several HUD "Affirmatively Furthering Fair Housing" rules and a related notice. It names the 2015 final rule (80 Fed. Reg. 42272), the 2021 interim final rule (86 Fed. Reg. 30779), the 2023 proposed rule (88 Fed. Reg. 8516), and the 2015 AFFH Assessment Tool notice (80 Fed. Reg. 81840). Any substantially similar future rules or notices would also have no effect. It would also bar using federal funds to design, run, use, or give access to a national database that maps racial or housing-access disparities, regardless of other laws. These changes would take effect upon enactment and could change how HUD links funding to local fair-housing plans.

HUD consultation and public report

If enacted, HUD would consult with state and local officials and public housing agencies. The goal is to develop recommendations that further the Fair Housing Act, consistent with Supreme Court rulings, and to consider options other than new rules. HUD would publish a draft report in the Federal Register within 12 months. The public could comment for at least 180 days. HUD would address comments and issue a final report that notes consensus and disagreements.
