Suspended Entries Remain Under Injunction

Entries of rebar produced and/or exported by Kaptan and the two Colakoglu companies that were entered or withdrawn for consumption during January 1, 2018 through December 31, 2018 remain enjoined from liquidation by CIT order while appeals continue. If the court decision is final and conclusive, Commerce will instruct CBP to assess CVD on unliquidated entries when the ad valorem rate is not zero or de minimis, but to liquidate without regard to CVD where the rate is zero or de minimis.

Subsidy Rates Set to De Minimis

Commerce amended the 2018 countervailing duty (CVD) rates for Kaptan Demir Celik Endustrisi ve Ticaret A.S., Colakoglu Dis Ticaret A.S., and Colakoglu Metalurji A.S. to de minimis (0.18 percent ad valorem) for the period January 1, 2018 through December 31, 2018. This amendment is applicable December 7, 2023.

Current Cash Deposit Rates Unchanged

Commerce stated it will not issue revised cash deposit instructions to U.S. Customs and Border Protection because superseding cash deposit rates from subsequent administrative reviews exist; the notice will not affect the current cash deposit rate. Examples of subsequent reviews include the 2019 administrative review published April 12, 2022 (87 FR 21640).
