Big Brother Checks If Imprisoned Veterans Double-Dipping Benefits

Summary

The VA is teaming up with the Federal Bureau of Prisons to check if veterans, their caregivers, or beneficiaries getting VA benefits are in federal prison for more than 60 days. If they are, the VA will adjust their benefits accordingly. This new 18-month program starts soon after a 30-day public comment period and helps make sure benefits are fair and accurate.

VA benefits suspended after 60 days imprisoned

If you are a veteran, surviving family member, caregiver, or other VA beneficiary who is confined following a felony or misdemeanor, VA will reduce or suspend your compensation, pension, or dependency and indemnity compensation starting on the sixty-first day of incarceration (i.e., after confinement exceeds 60 days). This rule applies to confinement in Federal, State, or Local institutions and is based on 38 U.S.C. 1505, 5106, and 5313.

VA will exchange personal identifiers with BOP

VA/VBA will receive data from the Federal Bureau of Prisons that includes personal identifiers such as Social Security number, full name, date of birth, length of sentence, place of confinement, type of offense, and scheduled or actual release date. Those data will be used to update VA master records and may trigger adjustments to benefits.
