Commerce Slaps Extra Taxes on Chinese Aluminum Foil Imports

Summary

The U.S. Department of Commerce found that some Chinese aluminum foil makers got unfair government help in 2023. Because of this, extra taxes (called countervailing duties) will apply to their products starting February 18, 2026. This means importers and buyers should expect price changes and keep an eye on these new rules to avoid surprises.

New Countervailing Duty Rates

If you import or buy aluminum foil from China, countervailing duties apply starting February 18, 2026. Commerce set ad valorem rates of 22.10% for Jiangsu Zhongji Lamination Materials Co., Ltd.; 120.81% for Shanghai Shenyan Packaging Materials Co., Ltd.; and 24.02% for the non-selected companies under review.

Non-Response Triggers Adverse Inference

Commerce found that Shanghai Shenyan Packaging Materials Co., Ltd. did not respond to the questionnaire and applied facts otherwise available with an adverse inference, resulting in a 120.81% ad valorem rate for Shenyan. If a company fails to respond in similar reviews, Commerce may assign an adverse facts available (AFA) rate that can be substantially higher than cooperating respondents' rates.

CBP Assessment Timing and Holds

U.S. Customs and Border Protection (CBP) will assess countervailing duties on appropriate entries in line with these final results. Commerce intends to issue assessment instructions to CBP no earlier than 35 days after publication, and if a timely summons is filed, CBP will be directed not to liquidate relevant entries until the time for parties to seek a statutory injunction has expired (within 90 days of publication).

Cash Deposit Collection Begins

CBP will collect cash deposits of estimated countervailing duties on shipments of the subject merchandise entered, or withdrawn from warehouse, for consumption on or after the publication date (February 18, 2026). These deposit requirements will remain in effect until further notice, and for non-reviewed firms CBP will collect the all-others rate or the most recent company-specific rate as appropriate.
