4 to 7 years for first fatal hit and run

For a first felony conviction of the class A hit-and-run homicide, the usual prison range is 4 to 7 years. The same range applies when the victim is an unborn child. Judges can adjust sentences under existing rules. This applies to crimes on or after July 1, 2026.

Harsher penalties for fatal hit and run

The law keeps criminally negligent homicide as a class B felony. It becomes a class A felony when a driver causes a death and knowingly fails to stop and give reasonable help as state law requires. The same upgrade applies when the death is of an unborn child. Starting July 1, 2026. When sentencing for this class A homicide, courts must add consecutive prison time for each extra conviction for failing to stop or give aid.
