Clearer travel plan details and refunds

Beginning Jan 1, 2027, sellers must clearly tell you what a one‑price travel plan includes before you buy. They must show which parts are insurance, which are travel help services, and which are cancellation waivers, and let you see prices and features for each. Preexisting condition exclusions must be shown before purchase and in your materials, and the materials must say if coverage is primary or secondary. You can cancel for a full refund for at least 15 days after mailed materials, or 10 days after in‑person or electronic delivery, if you have not started the trip or filed a claim. The law also states travel assistance services and cancellation waivers are not insurance.

New licenses and duties for travel sellers

Beginning Jan 1, 2027, travel retailers may offer travel insurance only under a licensed travel insurance limited producer. Producers must register retailers, train staff, name a licensed compliance lead, follow fingerprint and fee rules, and are liable for their retailers’ acts. A person may act as a travel administrator only if licensed as a property and casualty producer, MGA, or TPA; no adjuster license is needed for that work. Insurers stay liable for administrators’ acts and must keep and provide records.

Who can buy group travel coverage

Beginning Jan 1, 2027, travel insurance can be sold as individual, group, or blanket coverage. Groups like tour operators, schools, or employers can buy group or blanket policies if members share travel risk. Travel insurance is filed under the inland marine line, and related trusts and underwriting need director approval.

State tax on travel insurance

Beginning Jan 1, 2027, travel insurance premiums paid by state residents are subject to the state’s premium tax. For blanket policies, a company based in the state or an affiliate based here that buys the policy can also trigger the tax. If a policy covers multiple places, the premium is split among those places. The law does not set the tax rate.

Insurers must itemize insurance vs services

Beginning Jan 1, 2027, travel insurers must record where a policyholder lives or a business is based. They must report only the part of a one‑price plan that is true insurance, and exclude charges for travel help services and cancellation waivers. This changes how premiums are counted for taxes and rate review.

Limits on freebies in travel insurance

Beginning Jan 1, 2027, insurers and agents cannot market travel insurance as “free” or give insurance as a buying incentive. They also cannot offer rebates or special favors to induce a sale unless allowed in a director‑approved filing. Value‑added products and noncash gifts must be reasonable in cost compared to the premium, offered on fair, objective terms, and stay within caps set by regulation. Raffles are allowed only with no purchase required and within director‑set limits. The director may allow three‑year pilot programs with notice.

When Alaska’s new rules apply

Sections 1–3, 9, and 10 apply to policies issued, delivered, or renewed on or after Jan 1, 2027. On that date, the law also repeals AS 21.27.152.
