Stricter probation and online limits for offenders
If you are on probation for a listed sex offense, the court can add strict rules. You may have to take regular polygraph tests. You must give your email and online usernames to probation, who can share them with state troopers. The court can bar you from new online accounts, from contacting children under 16, from using a computer, or from living within 500 feet of schools.
Tougher crimes and penalties for child sexual material
The law creates two crimes for generated child sexual images: distribution and possession. Distribution is a class B felony, or class A with a prior similar conviction. Possession is a class C felony and has a narrow workplace exception. Having 100 or more items is prima facie evidence of distribution. The law also broadens illegal possession to include manipulated images made using a real child. Courts cannot use pretrial diversion and cannot suspend sentences for these crimes. Judges must add prison time for each extra count and run sentences back-to-back. These crimes are added to sex‑offense and sexual‑felony lists and to sentencing rules. There is no time limit to charge distribution crimes. Property used to commit these crimes can be forfeited after conviction.
Job and license bans after convictions
If you are convicted of the listed child sexual or exploitation crimes, the state revokes your teaching certificate for life. The department also cannot issue the specific state license named in law to applicants with these convictions.
More public access to serious juvenile cases
The department must share information, on request, about juveniles who were at least 13 when they committed certain listed felonies, including child sexual material distribution. Courts can open some juvenile delinquency hearings to the public when the case alleges serious child sexual material distribution and the department asks.
Broader abuse, enticement, and harassment laws
The law widens what counts as sexual abuse, exploitation, and harassment. Second‑degree sexual abuse now covers more age gaps, young victims, and guardian situations. Enticement applies when the other person is under 16 or you believe they are. Prosecutors do not have to prove the sexual act happened in enticement cases. Exploitation includes contact with semen. First‑degree harassment now includes contact with bodily fluids and touching private areas through clothing. Second‑degree harassment bans sharing sexual images of someone, repeated threats to minors, and repeatedly sharing images that show genitals.
Police can subpoena internet provider records
Law enforcement can ask the Attorney General for an administrative subpoena to get internet provider business records. They must have reasonable cause that an account was used in the listed crimes. The records help identify the account owner and gather evidence.
Protections for workers who report illegal images
If you work for an internet, cloud, or telecom service, you are exempt when you access illegal images only to prevent, detect, report, or respond. Clinicians who give plethysmograph tests in sex‑offender treatment are also exempt for work‑only possession. If you witnessed or were a victim and you report in good faith and cooperate, you cannot be prosecuted based on evidence found because of your report.
