Private calls and fast restraint notice for minors
Beginning July 1, 2026, minors in psychiatric hospitals get at least two hours of private phone or video calls each week with a parent, guardian, or another approved adult. The hospital must set up the calls when the minor, parent, guardian, or approved adult asks. Calls can be denied only by law, court order, or if a professional says they are not therapeutically advisable. Hospitals must also tell the Department of Health and the minor’s parent or guardian within 72 hours each time seclusion or any restraint is used. If a chemical restraint is used, the notice must name the psychotropic drug. A chemical restraint means using a psychotropic drug to control a patient or using more than needed to treat a symptom.
Unannounced hospital checks to protect minors
Beginning July 1, 2026, the Department of Health makes at least two unannounced inspections each year at every psychiatric hospital where minors stayed more than three nights in the past year. Inspectors interview at least half of minor patients without staff present unless needed for safety and use a standard, age-appropriate wellness check to spot abuse or neglect. When there is reasonable cause to suspect abuse or neglect, the department documents it, refers it right away to child protection, law enforcement, or other authorities, and notifies the parent or guardian in a timely way. If a facility blocks access, after notice and a hearing, a court must order entry so the licensing department’s staff can inspect.
