Faster sexual assault kit testing and updates
When a provider uses a kit, they must tell law enforcement within 14 days. Law enforcement must send the kit to an accredited or DPS lab within 20 days. The lab must test it within 120 days of receiving it. Law enforcement must try to tell the victim within 14 days after testing is done. Victims have the right to be told the kit’s location and test date.
Track your sexual assault exam kit
The Department of Public Safety runs a statewide system to track sexual assault kits. Providers, police, and labs must enter kit information. You can look up your kit and choose automated updates. The system keeps kit data confidential and not public.
Court and timing rules for kits
A criminal case cannot be dismissed only because kit testing missed a deadline, and late testing does not automatically exclude evidence. If the case is resolved before testing, providers, law enforcement, and labs do not have to meet the timing rules.
DPS rules and repeal of report
The Department of Public Safety can make rules to carry out this law, and that authority takes effect immediately. The law also repeals a prior reporting subsection that is superseded by the new tracking framework.
