Liens and claim deadlines on TOD assets
Beginning July 1, 2026, a TOD beneficiary takes the car or boat subject to any liens, contracts, or other interests. If the probate estate cannot pay allowed claims, the estate can collect from the TOD asset; if several TOD items transfer, claims are split by each item’s net value. Creditors or others must start any enforcement within 12 months of death, and only after the personal representative gets a written demand from a spouse, creditor, child, or their representative.
Transfer-on-death titles for cars and boats
Beginning July 1, 2026, you can add a transfer-on-death (TOD) to the title of a car or boat. You name 1 or 2 beneficiaries on a state form and pay a fee; all joint owners must sign. The title must show “transfer on death” or “TOD,” and the transfer happens at death without notice or acceptance. You keep full control while alive and can change or cancel the TOD at any time, including by filing a form and fee. A beneficiary gets title only if they survive you by 120 hours; if two are named, they take as joint tenants. After death, the state issues a new title when the beneficiary files proof of death, the application, and the fee. The law treats these transfers as nonprobate, and the department may set forms and fees by rule.
State rules and definitions for TOD
The Department of Administration can set rules, forms, and fees to run the TOD program, and those rules cannot start before July 1, 2026. The law also updates legal definitions so interests that transfer at death fit Alaska’s disclaimer rules.
