Stronger prosthetic coverage in private plans
Health plans must cover prosthetic and orthotic devices at least at Medicare levels. Coverage includes an initial device and one more if needed, plus parts and instruction. If repair costs over 60% of replacement, the plan must replace it. Plans must have two in-network providers or let you go out-of-network with an in-network copay. Plans cannot set higher cost-sharing for these devices than for inpatient physician and surgical services. These rules apply when your plan is issued, delivered, or renewed on or after the section’s effective date.
Insurance perks and wellness rewards with limits
You can get wellness rewards from your plan if it meets the law’s rules. All wellness rewards under your policy are capped at 20% of the cost of coverage per year. Insurers may offer value-added services tied to your coverage at no or lower cost, but their total cost per policy term cannot exceed the greater of $250 or 5% of the premium. Insurers can test new services for up to three years after notifying the director, if the director does not object within 21 days. Noncash gifts and raffles are allowed for marketing, with no purchase required and within director-set limits, and offers must be fair and based on objective rules.
Medicaid prosthetic coverage after federal approval
Medicaid may cover prosthetic and orthotic devices as an optional service. This takes effect only after the U.S. Department of Health and Human Services approves the state plan change or says approval is not needed. HHS must act by January 1, 2029 for this change to start.
No 'free' ads or rebate deals
Insurers and agents cannot say insurance is 'free' or use similar words. Property, casualty, and surety insurers cannot give rebates, credits, or special favors to win or keep customers, unless allowed in a filing with the insurance director. These rules protect buyers from misleading ads but may reduce off-record discounts for some.
Most changes start January 1, 2027
The law takes effect on January 1, 2027, unless a section sets a different date. Some sections have different effective dates.
