Lower child care costs and wider eligibility

The law caps your child care fee at 7% of your family’s monthly income. You pay this amount to your provider. This cap applies beginning July 23, 2024. The eligibility income limit is 105% of the state median monthly income, adjusted for family size. This limit takes effect only after federal approval by January 1, 2026 and, if approved, applies retroactively to July 23, 2024. The department sets subsidy amounts by region using market‑rate or cost‑of‑care studies.

Employer partnerships to add on‑site child care

The health department will partner with private employers to create on‑site or near‑site child care. This program starts only if the U.S. Department of Health and Human Services approves the state child care plan or says approval is not needed by January 1, 2026. If approved, the program is retroactive to July 23, 2024. The department must amend and submit the federal plan for approval.

Reserved slots and fair access for families

Any grant‑funded facility must hold at least 15% of its subsidized spaces, or one space, for child care assistance families when requested. Low‑income families get priority for openings. A grant‑funded facility cannot deny a child because of disability or family income. These rules apply starting July 23, 2024.

Grants for top child care providers

The department may give grants to the highest‑performing, licensed child care facilities. To get a grant, a facility must be licensed and have the state’s quality designation. The department sets the quality criteria with input from parents and a resource and referral agency. Grants depend on state funding. Rules take effect July 23, 2024.

Updated child care definitions and repeals

The law updates who counts as a child care facility. It covers licensed centers or homes and providers recognized by the federal government. It also repeals some earlier definitions, subsections, and 2024 session‑law sections to match the new framework. These changes take effect July 23, 2024.
